This document constitutes an official public offer (the "Offer") from RedNest (hereinafter referred to as the "Service") to any individual or legal entity (hereinafter referred to as the "User") to enter into an agreement for the provision of services on the terms set forth below.
By using the Service's API, including registering on the Service's website and obtaining access to the API, the User signifies their full and unconditional acceptance of the terms of this Offer (acceptance).
1. Definitions
- Service — A software system that provides the User with access to data storage and asynchronous task processing functionality via an application programming interface (API).
- User — Any individual or legal entity who has accepted the terms of this Offer and uses the Service's API.
- API (Application Programming Interface) — A software interface that allows the User's software to interact with the Service to perform data and task operations.
- User Data — Any information that the User stores, retrieves, deletes, or sends through the Service's API, including data in key-value storage and queues.
- Account — A personalized area for the User on the Service's website, containing their data and API access keys.
- API Key — A unique identifier provided to the User for authorizing requests to the Service's API.
2. Subject of the Agreement
2.1. The Service grants the User a non-exclusive right to use the API for data storage, retrieval, and asynchronous task processing as described herein.
2.2. As of the date of this agreement, the Service provides the following core functionalities via the API:
- Key-Value Operations: Methods for direct data manipulation, including `GET` (retrieve), `SET` (store/update), and `DELETE` (remove) data by key.
- Asynchronous Queues: Methods to push and pop data from FIFO (First-In, First-Out) and LIFO (Last-In, First-Out) queues.
- Webhook Integration: The ability to configure queues to automatically send data to a User-provided webhook endpoint.
3. Registration and API Access
3.1. To gain access to the API, the User must create an Account on the Service's website.
3.2. The User is solely responsible for maintaining the confidentiality of their API Key and other access credentials.
3.3. All actions performed using the User's API Key are deemed to be actions performed by the User.
3.4. The User must immediately notify the Service of any unauthorized access to their API Key.
4. Rights and Obligations of the Parties
4.1. The User agrees to:
- Use the API strictly in accordance with the terms of this agreement and applicable law.
- Not transfer the API Key to third parties.
- Be solely responsible for the configuration, security, and availability of any webhook endpoints they provide. The User acknowledges that the Service will send User Data to these endpoints.
- Not use the Service to store, process, or distribute illegal data, including but not limited to: malicious software, data infringing on copyrights, confidential information of third parties without their consent, and any other data whose circulation is prohibited by law.
- Not perform actions that could disrupt the normal operation of the Service, including creating an excessive load on the Service's infrastructure beyond reasonable use.
- Not attempt to circumvent technical limitations set by the Service, nor to decompile or reverse-engineer the API or the Service's software.
4.2. The Service agrees to:
- Make reasonable efforts to ensure the availability and functionality of the Service.
- Take commercially reasonable technical measures to protect User Data from unauthorized access.
4.3. The Service has the right to:
- Suspend or completely block the User's access to the API in the event of a violation of the terms of this agreement.
- Disable or suspend webhooks that consistently fail, respond with errors, or do not respond within a reasonable time frame, in order to maintain the stability of the Service.
- Make changes to the API's operation and the terms of service, with prior notification to the User (e.g., by posting on the website or sending an email).
- Establish limits on the number of API requests (rate limiting) and other resources to ensure stable operation for all users.
5. Ownership and Data Privacy
5.1. The User is the sole owner of the User Data they store using the Service. The Service claims no ownership rights over this data.
5.2. The Service does not review User Data, except as necessary for technical support or as required by law.
5.3. The User bears full responsibility for the content, legality, and lawfulness of their data usage. The Service is not responsible for User Data.
5.4. The User acknowledges that the Service is not a backup system. The User is responsible for creating their own backups of their data.
6. Disclaimer of Warranties and Limitation of Liability
6.1. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". The Service makes no warranties, express or implied, regarding uninterrupted or error-free operation, fitness for a particular purpose, or the reliability of data storage.
6.2. Webhook Delivery. The Service will make a reasonable effort to deliver data to the User-provided webhook endpoints. However, the Service does not guarantee the successful delivery, receipt, or processing of data by the User's server. The User is responsible for handling incoming webhook data and for any issues arising from their own server's availability, performance, or security.
6.3. The Service shall not be liable for any direct or indirect damages, including lost profits, loss of data, or harm to business or reputation, arising from the use or inability to use the API.
6.4. In any event, the aggregate liability of the Service under this agreement is limited to the minimum amount permitted by law or the amount paid by the User for the services in the last 12 months, whichever is less.
7. Termination
7.1. The User may stop using the Service at any time by deleting their data and account.
7.2. The Service has the right to terminate this agreement unilaterally, with notice to the User, in the event of a breach of its terms by the User.
7.3. Upon termination of the agreement, the Service has the right to delete all User Data without the possibility of recovery.
8. Final Provisions
8.1. The Service reserves the right to make changes to this Offer. The new version of the Offer becomes effective from the moment it is published on the Service's website, unless otherwise specified in the new version.
8.2. All disputes and disagreements arising in connection with the execution of this agreement shall be resolved through negotiations. If an agreement cannot be reached, the dispute shall be submitted to a competent court under the applicable legislation of the jurisdiction where the dispute arises.
8.3. All matters not regulated by this agreement shall be governed by the applicable legislation of the jurisdiction where the dispute arises.
